This page is maintained by PickOver (Nevada) to explain how PickOver works for buyers and sellers. These policies are working drafts adapted from common marketplace templates and will be reviewed by counsel before public launch. Questions: support@pickover.app.
Terms of Service
Welcome to PickOver. By accessing or using the app, the website, or any related service (the "Service") you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account, list items, or transact. By registering you represent that the information you provide is accurate and that you have authority to enter into this agreement.
2. Accounts
You are responsible for activity under your account and for keeping your credentials confidential. One account per person; up to five (5) shops may be operated under a single account. Notify us at support@pickover.app of any unauthorized use.
3. The marketplace
PickOver provides a venue connecting independent sellers ("Sellers") with buyers ("Buyers"). PickOver is not a party to transactions between users and does not take title to inventory. Sellers are responsible for accurate listings, fulfillment, taxes, and compliance with applicable law.
4. Fees
Use of basic features is free. When transactional features (Stripe Connect, shipping labels, ads) launch, applicable fees will be disclosed prior to acceptance.
5. Content license
You retain ownership of content you submit (photos, descriptions, messages). You grant PickOver a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt, and distribute that content to operate and promote the Service.
6. Prohibited conduct
See Acceptable Use below. Violations may result in listing removal, account suspension, or termination without notice.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PickOver does not guarantee uninterrupted or error-free operation.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKOVER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR REVENUES. Total liability for any claim shall not exceed the greater of (a) fees paid by you to PickOver in the prior 12 months, or (b) USD $100.
9. Indemnity
You will indemnify and hold harmless PickOver (Nevada) from claims arising out of your content, your transactions, or your violation of these Terms.
10. Governing law & disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Clark County, Nevada, and the parties consent to personal jurisdiction there.
11. Changes
We may update these Terms. Material changes will be announced in-app or by email. Continued use after the effective date constitutes acceptance.

Privacy Policy
This Privacy Policy describes how PickOver (Nevada) collects, uses, and shares information when you use PickOver.
Information we collect
Account data (email, display name, password hash), shop data (handle, name, bio, location, avatar), listing data (photos, descriptions, prices), messages, follows, cart activity, and basic device/log data (IP, user-agent, timestamps) for security and abuse prevention.
How we use it
To operate the Service, authenticate users, deliver listings, send transactional and account emails, protect against fraud, and improve the product. We do not sell personal information.
Sharing
With service providers acting on our behalf (hosting, email, payments, shipping, analytics) under data-processing terms; with other users as required by the Service (e.g., your shop is public); to comply with law or protect rights.
Retention
We retain account information while your account is active and for a reasonable period after closure to meet legal, tax, and audit obligations.
Your rights
Subject to applicable law you may access, correct, export, or delete your personal data by emailing support@pickover.app. California, EU/UK, and other residents have additional rights described in their local laws.
Children
PickOver is not directed to children under 13 and we do not knowingly collect their data.
Security
We use industry-standard safeguards including TLS in transit, encryption at rest, hashed passwords, and row-level access controls. No system is perfectly secure; report concerns to support@pickover.app.

Seller Agreement
1. Listings
Sellers must list only items they legally own and may sell. Listings must accurately describe condition, flaws, brand, size, and material. Stock photos must be your own or properly licensed; final-photo must be of the actual item.
2. Pricing & taxes
You set your prices in USD. You are responsible for collection and remittance of applicable sales, use, VAT, or income tax. PickOver may, where required, collect marketplace facilitator tax on your behalf.
3. Fulfillment
Once shipping is enabled, ship within 3 business days of an order. Provide tracking. Items must arrive substantially as described.
4. Prohibited items
No counterfeits, replicas, stolen goods, weapons, hazardous materials, recalled items, ivory or protected wildlife, prescription items, or anything else prohibited by applicable law.
5. Fees & payouts
Payouts route through our payment processor (Stripe). Fee schedule will be disclosed before transactional features go live and may include a platform commission, payment processing fee, and optional shipping label cost.
6. Suspension & termination
We may remove listings or suspend shops that violate these terms, receive substantial complaints, or otherwise harm marketplace trust.
Acceptable Use
You agree not to:
- Post hateful, harassing, threatening, sexually explicit, or violent content.
- List counterfeit, stolen, recalled, hazardous, or otherwise illegal items.
- Manipulate ratings, followers, or search rankings.
- Scrape, reverse engineer, or interfere with the Service.
- Misuse another person's identity, brand, or copyrighted material.
- Use PickOver to send spam, malware, or phishing.
- Circumvent fees by directing transactions off-platform.
Violations may result in immediate removal and account termination. We cooperate with law enforcement when required.
DMCA / Copyright
PickOver (Nevada) respects intellectual property rights. To report infringement, send a notice to support@pickover.app that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- The URL or other location of the allegedly infringing material on PickOver.
- Your contact information (address, phone, email).
- A statement that you have a good-faith belief the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act.
Counter-notices may be submitted using the same procedure. Repeat infringers will be terminated.
Returns & Refunds
Each Seller sets their return policy on their shop page. In the absence of a stated policy, the following defaults apply once orders launch:
- Items "not as described" may be returned within 7 days of delivery for a full refund including original shipping.
- Buyer's-remorse returns are at Seller discretion.
- Final sale items must be clearly marked in the listing.
- Disputes that cannot be resolved within 7 days may be escalated to support@pickover.app; PickOver may mediate but is not a guarantor.
Counterfeit, materially misrepresented, or never-arrived items are always eligible for a full refund.
